Guardianships & Conservatorships

Omaha, Nebraska Lawyers

Aging parents, special needs individuals and minors often are in need of compassionate decision makers in their lives. These arrangements are handled in probate court where property held for the benefit of another needs to be managed and living decisions need to be made.

When people are unable to make decisions about their finances, property, living situation or medical care, the courts may appoint a Guardian or Conservator.

The Nebraska Judical Branch website provides definitions for both Guardian & Conservator:

  • Guardian: Person(s) appointed by the court to make the personal decisions for the protected person, also known as the ward. The guardian has authority to make decisions on behalf of the protected person about such things as where to live, medical decisions, training and education, etc.
  • Conservator: Person(s) appointed to make financial decisions for the protected person. The conservator typically has the power to enter into contracts, pay bills, invest assets, and perform other financial functions for the protected person.

The attorneys at Dornan, Troia, Howard, Breitkreutz & Conway PC LLO can help you decide if this is right for you. If it something that is appropriate, we can help you set up your guardianship or conservatorship in Omaha and the surrounding areas.
